Shelby and SAAC at Odds

    I just checked out the SAAC Forum and read the Letter from Neil Cummings. It is straight Forward and binding. SAAC's Top Brass signed an agreement agreeing to the Terms of the Contract. If your signature is not worth the paper it is writen on, then we have way to many attorney's on this Planet. The Licensing Agreement was set to end on January 1, 2008. It is Shelby's right to NOT renew it when it ends. There should be a 6 Month sell off period in the Contract, that should last until the end of June, if that is true to there Contract, then SAAC can purchase the remainder of thier Merchandise to sell at a later date. As I have said before, SAAC will NOT die with out the Licensing Agreement.

    Just curious...I read the letter posted and wonder why Shelby is asking for all information collected by SAAC after 1996 (effectively the date of the last Registry). I have sent items to SAAC for the benefit of the organization and its members.

    Why is Mr Shelby requesting these items? Is that part of the agreement signed by SAAC?

    Maybe that question can't be answered, but it would be helpful to me in understanding this situation.

    I just have one thing to say after the events that transpired on Nov.25th between Shelby, his Lawyers, and SAAC.

    I have tried to get information from a few of the board members as I wanted to know whats going on like the rest of you. But in their defense it really wouldn't do much good to give out a lot of possibly misinformation that might change over the course of the litigation. Even though I would like to know....like all the rest I'll have to wait and see the outcome.

    Like was mentioned above I doubt if all the records do end up being returned to Carroll that it will be free to get information from the new club. My feeling is that SAAC did a lot over the years to keep the interest in Carroll at the level it is today....and he has prospered by it. Sometimes I feel he is a little too focused on the "prospering" end of it. :noway:

    He may be focused on the "prospering" end of things, but at this stage of the game I believe it's to ensure the endowment of the Childrens Heart Fund. Some people may look at it as greed, but I think it's his attempt to continue his legacy of charity into the future. He has helped alot of children over the years, and I think he wants to continue to do so. Given his work for charity I'm happy to pay for autographs etc.

    I don't really want to get into the Shelby Heart fund, but check the tax records for that organization. Seems the old man is keeping most of the money .Makes you wonder doesn't it? For what?.............a rainy day??:eek:

    Man...... do your home work........ He is banking as much as possible so the Foundation can keep going off the Interest long after he is gone. To be able to do that the Money has to build up. He is still helping Children.

    Hi all,
    My perception of the Shelby people has hit an all time low. I guess Shelby is also trying to trademark SAAC's name!!!!! Look at what was just posted on SAACforums:

    I noticed yesterday that Shelby has filed to register "SAAC" as a trademark for booklets in the field of Shelby automobiles, directories of Shelby automobiles and such (IC 016) and a bunch of other misc such as model cars, mugs, all in all covering most classes of marks. This filing was made November 16, 2007 which is interestingly one day before Shelby's attorney sent the letter to the club. Please note that this is only a filing, and will have to be examined by the Office and then published for opposition before it can be registered.

    Cole, not an attorney, but a browser of the Trademark Office listings.

    The above emplied date for that letter was incorrect. The date of the letter was actually November 14, 2007, two days before Shelby applied for SAAC 's trademark.

    all the time spent on this pi$$ing match will certainly delay the new KR's!!! BTW Amy, a Convertible KR would really look great in my collection.....Hint Hint!! after all, Christmas is just around the corner!!:thumbsup: Stay Positive Right?? RIGHT!!!!

    Books, beer mugs and car dealerships and toy cars. Nothing about deodorant or chili, so maybe he's out of those businesses.

    You can not shrug off the total responsibility of what
    is going on. You have a lot of clout in Shelby's
    organization and all aspects that effect your
    business.
    I do not agree with your final statement. The first
    letter of September 21, 2007 was answered in early
    October after SAAC had an opportunity to hire a
    lawyer. It was done in a phone call by SAAC's lawyer
    directly to Neil Cummings. Both lawyers know each
    other and SAAC's lawyer asked Neil to get
    clarification to the contents of the letter and get
    back to him. The next occurrence was the receipt of
    the second letter.
    The reason for the clarifications was that the letter
    was only 4 sentences long and said the licensing
    agreement would expire on February 1,1999. Besides the
    wrong year, what did this mean to SAAC going forward?
    What could be done to extend it etc. The letter really
    needed clarification and SAAC responded as soon as it
    acquired a lawyer. SAAC doesn't have an answering
    machine or even a phone to put it on so the only
    viable phone number was SAAC's lawyer which Neil has
    and did not use. I am being told there were no emails
    and when an old friend receives a letter from the
    other old friend's lawyer I can understand the
    confusion and hurt.
    I wish you would get involved and get things back on
    track. SAAC is the 5,000 members of this organization
    many of whom volunteer their time and hold a common
    bond of the enthusiasm for the cars built by Shelby
    American. A group this large and with this much
    passion will continue to make a strong statement.
    CSL's blunder will probably end up some day in
    Business 101 text books as what NOT to do for
    promotion of a brand.

    So the solution would appear to be: all of us buy stock and as majority stake holders we can determine the direction of the company:thumbup:

    I would have thought the stock would be higher....

    Are there other securities or shares in sub- corps we are no seeing?

    Shelby American had a nice ring to it. Shelby International sounds as if he's going global. SAAC should change to Shelby International Automobile Club and register SIAC before he does. They could claim its named after all the kids and pets in the club named Shelby...

It's not important who it came from or was sent to." LOL.... I think it DOES matter who sent it and to who it was sent to.......otherwise it is just a Rumor as far as I am concerned.

    Yes I felt the same way. Comments about Mattel should be easy enough to confirm and I'm sure the SCCA reps and/or the individual club officials could confirm the discussion it any. I'm pretty sure if this is happening someone has dropped a "dime" to SAAC

    I'm sure if it's bull one someone involved/implied will surely respond quickly to say so. If not maybe they have a reason
